Terms of Service

These Terms of Service govern your use of PropertyEngine. By creating an account or otherwise accessing the platform, you agree to these terms. If you don't agree, please don't use the service.

The service

PropertyEngine is a software-as-a-service platform for South African estate agencies, comprising listings, leads, sales pipeline, communications, reporting, website module and integrations as described on our marketing site.

We may add, change or remove features from time to time. Material changes will be communicated in advance to active customers.

Your account

You're responsible for keeping your account credentials secure and for all activity under your account. You must notify us promptly of any unauthorised access.

Each named user must have their own account; sharing logins is not permitted.

Acceptable use

You agree not to use the service to break the law, infringe anyone's rights, transmit malware, scrape at scale, or attempt to interfere with the integrity or performance of the platform.

Customer data

You retain ownership of all data you upload. We process it on your instructions to deliver the service and as set out in our Privacy Policy. We do not sell customer data, ever.

Fees & billing

Subscription fees are billed monthly or annually as selected. All prices exclude VAT. We may change pricing on at least 30 days' written notice; changes only apply at the start of your next billing cycle.

Termination

You may cancel at any time from the dashboard. We may suspend or terminate accounts for material breach, with notice where reasonable. On termination, you can export your data for 30 days.

Service levels & support

We target 99.9% monthly uptime. Support response targets vary by plan. Where we materially miss our SLA on Group plans, service credits may apply as set out in your order form.

Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We're not liable for indirect or consequential losses.

Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute will be referred to the High Court of South Africa, Western Cape Division.
